This License Agreement ("agreement", "terms") is a binding legal contract between you ("you", "your", "end user", "licensee") and Swell Presets, a division of Mandy Ford LLC ("us", "our", "we"). In this agreement, "presets" and "files" refer to the digital product you purchase from Swell Presets as identified on your sales receipt.
Your purchase of presets from Swell Presets grants you a license to use our presets under specific conditions. It is crucial to read and comprehend this agreement as it delineates your rights as a licensee, the acceptable usage of the presets, and the rights Swell Presets retains. Your act of purchasing, downloading, installing, or using the files signifies your acknowledgment and acceptance of this agreement's terms and your capability to legally bind the entity named on your sales receipt (“licensee”) to these terms. Should you disagree with this agreement's terms, you are not authorized to purchase, download, install, or use our presets.
Upon acquiring our files (or downloading our freebies), you receive a limited, non-exclusive, non-assignable, non-transferable, revocable Standard License. This license permits you to download, install, and utilize our presets for personal and professional photo editing. This license does not convey any ownership of our presets to you, nor does it represent a sale of any rights to our presets. You are granted only a Standard License to use our presets in compliance with these terms.
The files may be installed and utilized solely on the licensee’s devices. You are prohibited from making the files publicly accessible or available to non-licensed third parties. Redistribution of the files or any copies thereof to third parties is not allowed. Should a third party such as a friend, client, designer, independent contractor, employee, or freelancer need to install the files, they must acquire their own license directly from Swell Presets.
Sharing purchased presets with others, including friends, family, photographers, designers, clients, or coworkers, is illegal without our permission. Each purchase equates to a single license for one user. Each user may install a purchased preset collection on up to two (2) devices for their personal use. A preset purchased under a single-user license cannot be installed on multiple devices for use by multiple users.
Modifying, adapting, creating derivative works, reverse-engineering, sharing, selling, gifting, licensing, sub-licensing, transferring, assigning, hosting, distributing, copying, publishing on any public network, or commercially exploiting the presets in any way is strictly prohibited. You may not purchase or access the presets with the intention of creating similar or competitive products. If we suspect a breach of these terms, you agree to forfeit your license, discontinue use, and destroy all copies of the files. We will pursue all legal remedies to prevent further prohibited use and to address past violations.
Our work is protected under International Copyright & Intellectual Property Law, and we remain the exclusive owner of all rights, titles, and interests in our work. Under no circumstances are the licensed files to be sold or given away to any third party. Violators will face legal prosecution to the fullest extent of the law. The licensee agrees to treat the files as confidential and exercise due care to prevent unauthorized distribution.
Except as explicitly stated in these terms, no rights or ownership regarding the files are granted to you. We reserve all rights not explicitly granted under these terms.
Swell Presets is not liable for any direct or indirect losses or damages arising from the use of our presets.

Which Software Platforms Are Swell Presets Compatible With?
Our preset collections are designed for versatility. They are fully compatible with the free Lightroom mobile app across various devices, including iPhone, Android, Samsung, and Google phones. Additionally, our presets work seamlessly with all versions of the Lightroom desktop program on both Mac and PC Windows.
This wide compatibility makes it easy for you to create stunning images on any device or operating system you prefer!PLEASE NOTE: It’s important to follow our installation guides, as Lightroom Classic requires an XMP file import, and Lightroom Mobile and cloud-based options require DNG files. Each purchase includes both sets of files for your convenience!
Can I Share These Presets?
We appreciate your interest in our presets, but sharing them is not permitted. Upon purchasing Swell Presets, you are granted a non-transferable, single-user license. This license strictly prohibits the sharing, distribution, or installation of these presets on multiple devices for use by different individuals.
As per the licensing terms, each purchase entitles the licensee to use the presets on up to two personal devices, solely for your own use. Any form of redistribution or transfer of these presets (including partial changes), without explicit written permission from Swell Presets, constitutes a breach of the licensing agreement and is subject to legal action under copyright law.
Do I Have To Pay For The Lightroom App To Use These Presets?
Nope! Our presets are all compatible with the free version of Lightroom Mobile. If you wish to use these professionally with Lightroom Classic Desktop Professional Version, you may be required to purchase an Adobe Creative Suite subscription.
Will I Be Able To Achieve The Look With Just My Phone?
Yes! With any type of photography, lighting and composition matter so much more than the type of camera gear you are using. Of course camera gear helps, but we think our presets do a GREAT job on camera phone images! Take a peek at our review images for your final judgment, as these are most often taken without professional equipment!
Refund Policy & Billing Information
Do you offer refunds?
At Swell Presets, we adhere to a strict no-refund policy for our digital products and online courses. Due to the digital nature of our offerings, once a product has been downloaded or an online course accessed, it is deemed 'used'.
Accordingly, we are unable to provide refunds post-download or access, as the product is irrevocably considered consumed.
This policy is in line with the standard practices for digital sales to ensure the protection of intellectual property and the sustainability of the services provided. We encourage our customers to review their orders carefully and reach out to our support team for any pre-purchase inquiries to ensure their selections align with their needs.
Do I Have To Pay A Subscription?
Nope! There is no subscription required to purchase your presets. Upon purchasing Swell Presets, you are granted a single, one-time license to the digital files without the requirement of a recurring subscription. It is important to note that the responsibility for storing and backing up your purchased digital files rests solely with you, the purchaser. Our policy is not to retain long-term storage of these files. As such, we strongly advise you to secure your own copies on your local device or preferred backup solutions to ensure uninterrupted access and preservation of your purchased presets. This one-time purchase agreement absolves Swell Presets of any obligation to store or maintain the purchased digital files post-download.
I made a purchase but haven't received my downloads. What should I do?
Usually, when downloads don't arrive as expected, it's often due to a mistyped email address at checkout or the confirmation email being redirected to your spam folder.
If you're encountering this issue, we're here to assist! Whether it's updating the email on your order or resending the confirmation email, just reach out to us, and we'll sort it out promptly.
Keep in mind, if your purchase was made through PayPal or Apple Pay, the confirmation email is sent to the email account linked to your chosen payment method.NOTE: It can sometimes take up to 5 minutes for your payment to process through your bank, and downloads will not be sent until the payment has been processed. 9/10 times this is the issue! I upgraded to a new phone. Can I still download the presets?
Upgrading to a new phone? No problem! Your Swell Presets can come along. Remember, we don’t keep your purchased files for an extended period. It's crucial that you download and securely store your digital products within 14 days of purchase. We recommend saving them in a cloud storage service like Google Drive or Dropbox. This way, you can easily transfer them to your new device.
Keep in mind, our licenses are linked to you as a user, not to each individual download. So as long as you've saved your presets, they're yours to use across your devices.
